Terms & Conditions of PAYBACK points at Goomo

Definitions

In these terms and conditions, terms used are defined as below unless the context specifies otherwise:

  • “Amount” means Listed fare charges including taxes but excluding additional paid services, Insurance & Convenience Fee.
  • "Goomo" means “Goomo Holdings Services Indian Private Limited”
  • "Material Changes" means any changes including but not limited to change in the registered contact number (mobile or/and landline), change in the registered address of the Member
  • "Member" means customer registered with Goomo.
  • "Membership" means membership of Goomo’s PAYBACK’s loyalty program.
  • "Reward Points" means the PAYBACK points issued by Goomo.
  • "Reward Program" means Goomo’s PAYBACK loyalty program.
  • "Bonus Points" means the additional PAYBACK points issued by Goomo.
  • “Account” means the account in which a Member can check details of his/her tier & points, personal details, booking history as well as personalized offers. He/She would also have option to earn and redeem points.
  • “Eligible Spend” shall mean purchase of flight ticket by a Member through Goomo.com, that is eligible for PAYBACK Points.
General Conditions
  • The Reward Program, benefits and terms and conditions are valid from 1st January, 2018 onwards.
  • Membership is voluntary and a Member should be above the age of 18 with a correct mailing address in India and eligible as per the rules laid down by business. These rules are subject to change at Goomo’s sole and absolute discretion.
  • Membership in its current format is applicable for transaction at www.goomo.com only and has a lifetime validity unless terminated in terms thereof.
  • Membership and PAYBACK Reward Points are non-transferable except as specified in these terms and conditions.
  • The Reward Program at all times remains the property of Goomo and Goomo reserves the sole and absolute right (at any time) to withdraw the Member, the Membership and benefits arising from it, without prior notice.
  • For every Rs.100 of eligible spend for Flight bookings, members will earn 2 PAYBACK reward points. This is subject to the terms and conditions laid down here. The Reward Points and terms thereof may be modified at the sole discretion of Goomo without prior intimation to the Member.
  • Goomo shall not be liable in the event of failure fulfill any of its obligations under this terms and conditions due to flood, earthquake, storm, cyclone or any other acts of god of similar nature, war strike, lockout, or governmental or judicial or quasi-judicial policies/intervention/direction /prohibition or change in law or for any other reasons beyond its control.
  • A waiver of any of the terms and conditions by Goomo shall not be deemed to be a continuing waiver, but shall apply solely to the instances to which the waiver is directed.
  • All claims and disputes arising under the terms and conditions should be notified to Goomo within 45 days’ post travel end date after which no Member shall have any claim against Goomo.
  • Goomo reserves the right to change, at any time, these terms and conditions, features and benefits offered on My Goomo.
  • Goomo shall have the right to transfer, assign and sell in any manner, in whole or in part, the Reward Program to any third party of its choice without reference or intimation to the members.
  • Goomo shall not be liable for any loss or damage, whether direct or indirect, resulting from termination or change of the Rewards Program or any of its facilities, benefits or arrangements which are made available to the Members. The Rewards Program may be modified at the sole discretion of Goomo from time to time without any intimation to the Member.
  • The Member grants his/her consents to Goomo for creating, storing, maintaining and updating the Member’s data. Such data shall include data like name, address, telephone number, mobile number, date of birth, areas of interest, preferences etc. as provided by the Member, usage data (including without limitation, transactions and Reward Points accrued, etc.), and data concerning contacts with Goomo (including without limitation, enquiry regarding membership) for the purpose of providing relevant information, personalized offers and customer services to the Member.
  • All data provided shall be protected and used by Goomo only in the manner indicated in Goomo's Privacy Policy mentioned at the www.goomo.com.
  • The Member solicits and authorizes Goomo to contact him by voice call, sms and/ or email with respect to any promotion/offer or communication in relation to the reward program. The Member hereby unconditionally consents that such contact by Goomo is (a) upon the request and authorization of the Member, (b) 'transactional' and not an 'unsolicited commercial communication' as per the guidelines of Telecom Regulation Authority of India (TRAI) and (c) in compliance with the relevant guidelines of TRAI or such other authority in India and abroad. The Member will indemnify Goomo against all types of losses and damages incurred by Goomo due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous compliant raised by the Member on Goomo with respect to the intimations mentioned above or due to a wrong number or email id being provided by the Member for any reason whatsoever.
  • PAYBACK Partners may change any of the terms and conditions of their business at any time without notice to the Member. Goomo is not responsible for informing Member of any such changes.
  • Goomo and PAYBACK partners shall not be liable to the Member or his/her nominee or companion, for any indirect or consequential loss, damage or expense of any kind whatsoever, arising out of or in connection with Goomo, including the functioning of the helpline and/or provision or the refusal to provide any benefits, whether such loss, damage or expense is caused by the negligence or otherwise, and whether Goomo and/or any of PAYBACK Partners have any control over the circumstances giving rise to the claim or not.
  • In case of bookings where payment is done through a combination of multiple payment modes (Cash, PAYBACK Points, Gift Voucher, MoCash), cancellation penalty will be deducted on priority basis first from PAYBACK Points, then Cash, then MoCash (Goomo Wallet) and then from Gift Voucher. In other words, refunds will happen in this order: Gift Voucher -> MoCash -> Cash (Cards/Netbanking/m-wallet) -> PAYBACK Points. Refund to a particular source will upto the amount paid through that source.
Enrolment
  • It is the Member’s responsibility to share the correct communication details with Goomo at the time of enrolling into the reward program or signing up for his account at Goomo.
  • Members are required to inform all Material Changes to Goomo immediately.
  • Goomo reserves the right to offer Membership to any customer as it may deem fit.
  • Membership to the Reward Program is at the sole discretion of Goomo and it may refuse membership to any applicant without assigning any reasons.
Reward Points Accrual
  • The Member agrees that by quoting his/her membership detail to Goomo, he/she has read and understood the prevailing terms and conditions of the reward program and PAYBACK. The Member also confirms that he/she is bound by such terms and conditions and voluntarily agrees to pay all specified charges.
  • Members can accrue Reward Points through a transaction with Goomo for the purchase of selected products and/or services paid by any mode of payment agreed upon by the Goomo.
  • All Reward Points relating to the Member’s transactions shall be credited to the Member Account within 3 working days after travel end date or checkout, wherever applicable
  • The method of earning Reward Points from Goomo is subject to change from time to time.
  • Reward Points are granted in whole number. Customers will not be awarded Reward Points in fractions. Reward Points will get rounded down to the nearest whole number.
  • Reward Points are valid for a period of three years from the date of credit into the Member’s account.
  • In the event of the Member not using his/her Membership to accumulate and/ or redeem Reward Points for a continuous period of 24 months (2 years), the accumulated Reward Points and the Membership account will expire. All points accumulated on such accounts and lying unused at the time of expiry shall lapse.
  • Reward Points from the Member’s account cannot be pooled or combined with the Reward Points of another Member’s account.
  • Complaints on Reward Points not credited to account will be entertained only if the date of travel is not older than 45 working days. The Member must provide proof of transaction as required by Goomo to register any Reward Points dispute.
  • In case of flights cancellation directly with airline, the credited reward points will be deducted by Goomo from customer's account. In case the customer utilized the credited reward points (in partial or full), equivalent amount will be deducted from the refund amount
  • Reward Points can be earned on purchase of following travel products from website of Goomo, www.goomo.com from 30th Jan ’18 onwards:
    • Domestic Air Tickets (Within India)
    • International Air Tickets
    • Online Hotels in India and International
  • Please note, reward points are not earned on following products:
    • Online Domestic packages
    • Online International packages
    • Offline Hotel or Flight bookings
    • Bookings done through the call center
    • Bookings done under Goomo’s employee referral program or friend and family program.
    • Bookings done on through Goomo corporate channels like affiliate, B2B, MICE etc.
    • Bookings done by travel agents. In case it is found that a travel agent has accrued points by not disclosing his status as travel agent the Membership will be revoked
  • Travel agent, who is a PAYBACK member, is barred from earning in Goomo, however he/she is eligible for redemption of points in Goomo, earned elsewhere in PAYBACK network.
  • The Member should be above the age of 18 and eligible as per the rules laid down by business for redemption process. These rules are subject to change.
Reward Points Redemption
  • Reward Points can be redeemed on purchase of following travel products from online website of Goomo, www.goomo.com
    • Domestic Air Tickets (Within India)
    • International Air Tickets
    • Online Hotels in India & International
  • Please note, reward points cannot be redeemed on following products:
  • Online Domestic packages
  • Online International packages
  • Reward points can also be redeemed in PAYBACK partner network
  • In the event of a dispute between Goomo and member on the redeemed item, the decision of Goomo shall be deemed as final and binding
  • The Member may not rely upon the continued availability of any rewards or award level
  • Goomo does not accept liability for damage to persons or property whatsoever caused in relation to rewards redeemed by the Member in relation to the reward program.
  • To activate redemption, Member must update his/her date of birth in his/her account under profile section and use the generate PIN option to view and redeem points
Termination
  • At no time PAYBACK Reward Points will be credited to or rewards request be issued to, purchased by, or sold to any person other than the Member. The Member acknowledges that no claims on wrongful transfer of points shall be maintainable against Goomo. Any such Reward Points or requests for rewards are void. Any person who commits such acts is liable for damages, litigation and related costs to Goomo, which reserves the right, to terminate or deactivate such Member’s Membership.
  • Misuse of Membership benefits may result in disqualification of the Membership or withdrawal of benefits at the sole discretion of Goomo.
  • Disqualification of a Member, arising out of his/her misconduct, fraud and misuse of rewards or acts in a manner inconsistent with any central/state/local laws, statutes or ordinances, may result in immediate termination of the Membership and cancellation of all Reward Points and rewards. Any Member so disqualified shall not be entitled to redeem his Reward Points after such disqualification.
  • Goomo reserves the right to terminate the reward program, by giving 30 working days' notice to the Member.
  • Upon the death of a Member, his/her Membership will be closed and all outstanding Reward Points will lapse.
